Introduction

Welcome to Video Journal Daily (“we,” “us,” or “our”). By using our application (the “App”), you agree to these Terms of Service (“Terms”). If you do not agree, please do not use the App.

Eligibility

You must be at least 16 years old (or the minimum age required by your country’s laws) to use the App.

Description of Services

• Video Journal Daily is a personal video journal app that allows users to record, encrypt, and store video journal entries.
• Free Users: Video and photo files are stored locally on your device. Encrypted metadata (transcripts, sentiment, and optional context like weather, location, and steps) is stored on our servers.
• Pro Users: Video journals, photos, and thumbnails are encrypted on your device and backed up to the cloud via an active Pro subscription. Pro also enables multi-device access.
• Optional Attachments: You may choose to include photos, weather data, location, and walking steps with your journal entries.
• The App never accesses or processes your video content or transcripts.

Subscriptions & Billing

• Pro subscriptions are billed through the Apple App Store, Google Play Store, or our web checkout. We do not store payment card details directly.
• Subscription pricing, billing cycles, and renewal terms are displayed before purchase.
• Refunds are handled by the applicable payment provider in accordance with their respective refund policies.
• Upon expiration of a Pro subscription, your cloud-backed data (videos, photos, and thumbnails) remains available for download for 30 days. After 30 days, all cloud-stored files are permanently deleted. Server-side metadata and locally stored files are not affected.
• We reserve the right to enforce per-video file size limits (currently 900 MB) and reasonable usage thresholds to ensure service quality for all users.

Acceptable Use

• The App is intended solely for personal video journaling. You may not use the service as general-purpose file storage, for hosting or distributing content to others, or for any commercial purpose.
• You may not upload non-journal content, use automated tools for bulk uploads, or otherwise attempt to circumvent storage or usage limits.
• We reserve the right to suspend or terminate accounts that abuse storage or violate this acceptable use policy.

User Responsibilities

• Your journals are encrypted using a key derived from your account password. You are responsible for keeping your password safe. If lost, we cannot recover your journals.
• If you uninstall the app or lose your device, locally stored videos and photos cannot be recovered unless you have an active Pro subscription with cloud backup.
• You are responsible for downloading your cloud-backed journals within 30 days of your Pro subscription expiring. After this period, cloud data is permanently deleted.
• You must not attempt to circumvent storage limits, usage restrictions, or security measures.

Privacy and Security

• End-to-End Encryption: All videos, photos, and transcripts are encrypted on your device before being uploaded.
• We Never Access Your Journals: Your video content and transcripts remain private. We cannot decrypt them.
• Optional Data Collection: Weather, location, walking steps, and photos can be added to journal entries only if you choose to include them.
• No Data Sharing: We do not sell or share your data with third parties.

Account Termination & Deletion

• You can delete your account at any time. Upon deletion, all server-side data — including metadata and any cloud backups — is permanently erased.
• If you cancel your Pro subscription without deleting your account, cloud-stored files are deleted after 30 days. Your local data and server-side metadata remain intact.
• We may suspend or terminate accounts that violate these Terms, including the Acceptable Use policy. In such cases, cloud data may be removed without a grace period.

Disclaimers

• The App is provided ‘as is,’ with no warranties of any kind.
• We are not responsible for lost journals due to app uninstallation, device failure, or lost passwords.
• We are not liable for data loss resulting from subscription cancellation if you do not download your cloud data within the 30-day grace period.

Governing Law

These Terms are governed by the laws of your country and international privacy regulations, including GDPR (Europe).

Changes to These Terms

We may update these Terms periodically. Continued use of the App means you accept any changes.
